Методологические подходы к определению недееспособности в зарубежной судебно-психиатрической практике

Статья посвящена обзору основных зарубежных методологических подходов к судебно-психиатрической оценке «capacity» (недееспособности и ограниченной дееспособности) при психических расстройствах. Приведены правовые и клинико-экспертологические понятия, этические принципы, теоретические и экспертологические модели определения недееспособности: «the Grisso model», модель «видов повседневной активности», трехуровневая модель способности к финансовой деятельности, функциональный подход. Выделены основные направления зарубежных исследований в данной области. Обсуждается возможность применения зарубежного опыта в российской практике.
