The analysis of the legal problems relating to psychiatric activity is carried out. It is emphasized that their main reasons root in contradictions between the Constitution of the Russian Federation, its federal laws and subordinate regulations, and also in selectivity of execution. These contradictions are tracked concerning the written informed consent to rendering the psychiatric help, concept of public danger of patients, their involuntary hospitalization in a psychiatric hospital, preservation of medical secret, carrying out medicosocial examination in the absence of a consent to it patients, safety of the medical workers rendering psychiatric help. Need of organization of the patients rights protection service is noted. Legal problems in psychiatry have system character and their decision in the shortest terms.
