Analysis of repeated forensic psychiatric assessments in cases of changing civil status with consideration of court decisions

Abstract

We have carried out the comprehensive analysis of repeated inpatient forensic psychiatric examinations in civil cases on recognizing examinees as incompetent, competent, or having limited legal competence, which had been conducted between 2016 and 2022 at the V. Serbsky National Medical Research Centre for Psychiatry and Narcology.
It was found that repeated examinations were ordered mainly for persons with schizophrenia; in 27 (61.4%) cases the second conclusion concurred with the primary one, and in 17 (38.6%) cases it did not. In all cases of revised main expert conclusion, the ability of an examinee to comprehend the meaning of his/her actions or control them during the re-examination was rated higher due to emphasis on real-life functioning. In 14 cases of discrepancies in the expert opinion, the court based its decision on the second examination.
