Abstract

The paper reviews the subject of forensic psychiatric examination of the accused when defining their legal capability, the rationale for commissioning expert evidence and the tasks thereof, the content of basic forensic notions in evaluating criminally-remedial capacity (that implies the ability to defend one’s own legal rights and interests in the course of legal proceedings), the aspects of expert assessments when dealing with psychogenetic mental disorders associated with stress. Besides, identified are criteria of forensicpsychiatric evaluations of criminal incapacity in transient psychotic disorders and depressive episodes. Presented are data on follow-up studies of patients.
