Forensic psychiatric evaluation of organic personality disorder due to epilepsy (legal criterion for insanity and diminished responsibility)

Abstract

Based on the clinical-psychopathological study, and pursuing the objective of developing criteria for diagnosis and forensic-psychiatric assessment of organic personality disorder due to epilepsy, we have obtained data on the clinical and criminological peculiarities of patients with epilepsy. We have proposed the structure of organic personality disorder due to epilepsy as the totality of cognitive disturbances and personality alterations with the predominance of either explosive or defensive traits. We have identified the forensic expert tasks, pertaining to the establishment and substantiation of the legal criterion of the insanity and diminished responsibility formula for patients with various types of personality alterations.
