The aim of this scientific review is systematizing ideas about the role of situational factors in the mechanisms of legally significant behaviour. It is demonstrated, that they are mediated by a wide range of individual characteristics presented at the constitutional, characterological and personal (semantic) level, each of which is transformed in its own way under the influence of certain morbid conditions. The modern theoretical concepts of the "psychological situation", transactionality of personality and situation, the model of enactivism, considering the processes of cognition as a result of the interaction of the subject with the environment, are given. Therefore, in order to objectify the category of a situation and its impact on the voluntariness of legally significant behavior, it is most appropriate to study personal-situational interaction by detecting mechanisms for subjective processing of external circumstances.
