PART I of this comprehensive review examines the development of the insanity defense in the common law system of England by briefly reviewing generalities of the legal systems of the world in order to delineate the differences between Penal code systems and common law systems. There is a brief description of the most relevant ancient legal systems and their philosophical approaches to the defective minds of people that committed crimes. This is followed by a historical analysis of the development of the English legal system.
