Presumption of mental health, presumption of innocence and presumption of legal sanity

Abstract

In this article the authors analyze theoretical and practical issues of recognition of the presumption of mental health and discuss its content and possible consequences. The authors compare it with the presumptions of legal sanity and innocence. Without establishing a definition and legal consequences in the law, the presumption of mental health lacks legitimacy and legal certainty. The presence in the Russian legislation of provisions concerning presumption of mental health is mandatory for its application. Proponents of the presumption consider it important for protection of the rights of citizens in both general and forensic psychiatry. However, its necessity and practical value have not yet been proven, and there are other legal guarantees and mechanisms to meet similar challenges. Legalization of the presumption of mental health is possible, if it is to address problems for which there are no other solutions.
